Terms of Service

These rules explain what you can expect from CRY-EX and what CRY-EX expects from customers, drivers, merchants, advertisers, and administrators.

Effective: 26 October 2026 · Version: 2026-10-26

This is a hosted pilot, not a live commercial delivery service. GCash payment stays off until the operator connects a live GCash account, and the app never pretends a payment went through. Reach advertising uses a test budget and buys no real ads. Do not use CRY-EX for an urgent delivery.

1. Who runs this pilot

“CRY-EX,” “we,” and “us” mean the person or organization operating the CRY-EX service on the cry-ex.com website. “You” means the person using any CRY-EX site or account.

The operator has not yet published its registered legal name or business address. That information must be added before CRY-EX accepts real commercial activity. Until then, treat this service as a product pilot and use test information only where the screen tells you to do so.

2. When these terms apply

These Terms apply when you visit or use the CRY-EX landing, Customer, Driver, Merchant, Reach, or Admin sites. When you register, you agree to the version shown above. You also acknowledge the separate Privacy Policy, which explains how personal data is handled.

You must be at least 18 years old and legally able to enter an agreement. If you use CRY-EX for a business, you confirm that you are allowed to act for that business.

Accepting the Privacy Policy is not blanket consent to every use of data. CRY-EX will ask separately when a specific choice is needed, such as browser location permission or an optional identity-check step.

3. Your account

  • Give accurate, current information and use an email address you control.
  • Keep your password and one-time links private. Never share a GCash PIN, payment OTP, password, or admin setup code.
  • Use the correct site for your role. A customer account cannot be used as a driver, merchant, or administrator account.
  • Tell the operator through the in-app Help tool if you think somebody accessed your account.

CRY-EX may pause or close an account to protect people, investigate misuse, meet a legal requirement, or keep an unsafe or unfinished pilot from operating. Where practical, we will explain the reason and give you a way to ask for review.

4. Using CRY-EX

Customers

Describe the pickup, drop-off, recipient, parcel, and order accurately. Do not request delivery of unlawful, dangerous, restricted, stolen, or misleadingly described items. Check the quote and payment details before continuing.

Drivers

You may accept work only after the required account and identity checks. Follow road, licensing, safety, and delivery laws. Do not claim a job you cannot safely complete, misuse recipient details, or keep copies of customer information after the job.

Merchants and advertisers

Keep store details, prices, availability, preparation times, menus, and offers accurate. You are responsible for the products and claims you publish. Reach campaigns remain subject to operator review and, in this pilot, spend only a simulated budget.

CRY-EX helps people find and coordinate with each other. It does not make every user an employee, agent, or representative of the CRY-EX operator, and it does not guarantee that another user will perform as promised.

5. Quotes, prices, and payments

Quotes depend on the locations, route, vehicle, item value, merchant, and promotions entered at that time. A quote may change if those details change or if a clear calculation error is found.

GCash checkout is offered only when the operator has connected a GCash account. Until then it is unavailable and no money is taken online. CRY-EX never asks for your GCash PIN or OTP.

If CRY-EX later enables a live payment, the checkout must clearly say that money can move before you confirm. The payment provider’s own terms and privacy notice will also apply. Nothing in these Terms removes consumer rights that the law does not allow a business to waive.

6. Identity checks, maps, and outside services

Driver onboarding may use an outside identity-check provider. The provider is Sumsub, used only when identity checks are turned on. Read the on-screen test or live status before uploading a document, and continue only if you understand where the document will be sent.

Maps use OpenStreetMap tiles, a Nominatim-compatible address search, and OSRM routing. Routes and addresses can be incomplete or wrong. Check the written address and real-world conditions; do not rely on the map for emergency response or safety-critical navigation.

CRY-EX also relies on outside services for hosting, email, and payments. Their availability and separate rules can affect the service. The Privacy Policy names the current providers and explains what data they may receive.

7. Safety and fair-use rules

Do not:

  • break the law, threaten anyone, discriminate, harass, or help another person do so;
  • send malware, probe security without written permission, bypass account or bot checks, scrape at harmful volume, or interfere with the service;
  • impersonate someone, create deceptive listings or ads, manipulate ratings, or submit false identity documents;
  • use another person’s personal data for anything unrelated to the booking, order, support request, or legal duty that made it available; or
  • use a TEST ONLY feature as proof of payment, identity, delivery, advertising spend, or regulatory approval.

8. Information and content you provide

You keep ownership of your store text, menu images, ads, messages, reviews, and other content. You give the CRY-EX operator a limited permission to store, copy, show, resize, and transmit that content only as needed to run, secure, support, and demonstrate the service.

You confirm that you have the right to provide the content and that it does not violate another person’s rights. CRY-EX may hide or remove content that is unlawful, unsafe, misleading, or outside the purpose of the pilot.

The CRY-EX name, shared logo, interface, and software remain owned by their respective owners. These Terms do not give you permission to copy or rebrand them except as the law or a separate licence allows.

9. Availability and changes

The pilot may be changed, paused, reset, or taken offline. Test accounts and test records may be deleted during maintenance or decommissioning. Features can fail because an outside provider, internet connection, map, email service, or test environment is unavailable.

We aim to describe important limits clearly, but we do not promise uninterrupted access, a successful match, a particular driver or merchant, exact map or ETA data, or that a pilot feature will become a live service.

10. Responsibility when something goes wrong

Each user remains responsible for their own actions, listings, goods, vehicles, legal duties, and decisions. CRY-EX is not a substitute for checking a driver, merchant, recipient, route, item, price, or payment status.

To the extent the law permits, the pilot is provided as available and the operator is not responsible for indirect or unexpected losses caused by relying on a test feature. This does not exclude responsibility that cannot legally be excluded, including applicable consumer rights, fraud, wilful misconduct, or liability for injury where the law does not allow an exclusion.

11. Updates and ending use

We may update these Terms when the service, providers, or law changes. A new version will show a new effective date. If a material change affects registered users, CRY-EX should show a clear notice and request a new agreement where required rather than silently treating continued use as acceptance.

You may stop using the service at any time. Account deletion is not yet self-service in this pilot; use the in-app Help tool to request closure. Some records may need to remain for security, disputes, or legal duties as explained in the Privacy Policy.

12. Philippine law and contact

These Terms are intended to be read under the laws of the Philippines, without taking away any protection you receive under a law that must apply. Try the in-app Help tool first so the operator can investigate a problem with the correct account or booking.
